Therefore, the processing of personal data, such as the name, address, e-mail address or telephone number of a data subject, is carried out in accordance with the applicable European and national legal regulations.

If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.

We use, among other things, the following terms in this privacy policy and on our website:

An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more special characteristics that are an expression of the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.

Data Subject

Data subject is every identified or identifiable natural person whose personal data is processed by the controller responsible for the processing.

Processing

Restriction of Processing

Restriction of processing is the marking of stored personal data with the aim of limiting its future processing.

Profiling

Profiling is any kind of automated processing of personal data which consists of using these personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning work performance, economic situation, health, personal preferences, interests, reliability, behavior, whereabouts or movement of this natural person.

Pseudonymization

Pseudonymization is the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that this additional information is kept separately and is subject to technical and organizational measures ensuring that the personal data is not assigned to an identified or identifiable natural person.

Controller or Controller Responsible for Processing

Controller or controller responsible for processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of processing personal data. Where the purposes and means of such processing are specified by Union law or the law of the Member States, the controller or the specific criteria for its nomination may be provided for by Union law or the law of the Member States.

Processor

Processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Recipient

Recipient is a natural or legal person, public authority, agency or other body to whom personal data is disclosed, regardless of whether it is a third party or not. However, authorities that may receive personal data under Union law or the law of the Member States in the context of a specific investigation mandate shall not be regarded as recipients.

Third Party

Third party is a natural or legal person, public authority, agency or other body other than the data subject, the controller, the processor and the persons who, under the direct responsibility of the controller or processor, are authorized to process the personal data.

Consent

Consent is any freely given, specific, informed and unambiguous indication of the data subject’s wishes in the form of a statement or another clear affirmative action, by which the data subject indicates that they agree to the processing of personal data concerning them.

Registration

The data subject has the possibility to register on the website of the controller responsible for processing by providing personal data. Which personal data is transmitted to the controller responsible for processing results from the respective input form used for registration. The personal data entered by the data subject is collected and stored exclusively for internal use by the controller responsible for processing and for its own purposes. The controller responsible for processing may arrange for the transfer to one or more processors (for example, a parcel delivery service provider), who also use the personal data exclusively for internal use attributable to the controller responsible for processing.

By registering on the website of the controller responsible for processing, the IP address assigned by the Internet Service Provider (ISP) of the data subject, the date and the time of registration are also stored. The storage of this data takes place against the background that only in this way can misuse of our services be prevented, and this data can, if necessary, enable clarification of committed criminal offenses and copyright infringements. In this respect, the storage of this data is necessary to secure the controller responsible for processing. This data is generally not passed on to third parties unless there is a legal obligation to pass it on or the transfer serves criminal prosecution or legal enforcement.

The registration of the data subject through the voluntary provision of personal data serves the controller responsible for processing to offer the data subject content or services which, due to their nature, can only be offered to registered users. Registered persons are free to have the personal data provided during registration completely deleted from the data records of the controller responsible for processing.

The controller responsible for processing provides every data subject, at any time upon request, with information about which personal data concerning the data subject is stored. Furthermore, the controller responsible for processing corrects or deletes personal data at the request or indication of the data subject, insofar as this does not conflict with statutory retention obligations.

Personal data is also processed by Sprachbrücke- Übersetzungsbüro when you provide it voluntarily. This happens, for example, whenever you contact us. The personal data transmitted in this way will of course only be used for the purpose for which you provide it when contacting us. The provision of this information is expressly voluntary and with your consent. If this concerns information relating to communication channels (for example, e-mail address, telephone number), you also consent to us contacting you via this communication channel, if necessary, in order to answer your request.

Security

Sprachbrücke- Übersetzungsbüro takes numerous technical and organizational measures to protect your personal data against accidental or unlawful deletion, alteration or loss and against unauthorized disclosure or unauthorized access.

Nevertheless, internet-based data transmissions may generally have security vulnerabilities, so absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, for example by telephone.

Links to Other Websites

This website contains links to other websites (so-called external links).

Sprachbrücke- Übersetzungsbüro is responsible as a provider for its own content in accordance with the applicable European and national legal regulations. These own contents must be distinguished from links to contents provided by other providers. We have no influence on whether the operators of other websites comply with the applicable European and national legal provisions. Please refer to the privacy policies provided on the respective website for information on this. For external content made available for use through links and specifically marked as such, Sprachbrücke- Übersetzungsbüro assumes no responsibility and does not adopt its content as its own. For illegal, incorrect or incomplete content, as well as for damages resulting from the use or non-use of the information, the provider of the website to which the link leads is solely liable.

Cookies

In order to make our website user-friendly for you and optimally adapt it to your needs, we use cookies. Cookies are small text files which, as soon as you visit a website, are sent from a web server to your browser and stored locally on your terminal device (PC, notebook, tablet, smartphone, etc.).

Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string through which websites and servers can be assigned to the specific web browser in which the cookie is stored. This enables the websites visited to distinguish the individual browser of the data subject from other web browsers containing other cookies. A specific web browser can be recognized and identified again through the unique cookie ID. This information is used to automatically recognize you and facilitate navigation when you visit the website again using the same terminal device.

You can accept or reject cookies – including for web tracking – through the settings of your web browser. You can configure your browser so that the acceptance of cookies is generally refused or so that you are informed in advance when a cookie is to be stored. In this case, however, the functionality of the website may be impaired (for example, when placing orders). Your browser also provides a function for deleting cookies (for example, “delete browser data”). This is possible in all common web browsers. Further information can be found in the operating instructions or in the settings of your browser.

Collection of General Data and Information

The website of Sprachbrücke- Übersetzungsbüro collects a range of general data and information with every visit to the website by a data subject or an automated system. This general data and information is stored in the server log files. The following may be collected:

  • the browser types and versions used

  • the operating system used by the accessing system

  • the website from which an accessing system reaches our website (so-called referrer)

  • the sub-websites accessed through an accessing system on our website

  • the date and time of access to the website

  • a web protocol address (IP address)

  • the Internet Service Provider of the accessing system

  • other similar data and information used for hazard prevention in the event of attacks on our information technology systems

When using this general data and information, Sprachbrücke- Übersetzungsbüro does not draw any conclusions about the data subject. Rather, this information is required to:

  • correctly deliver the contents of our website

  • optimize the contents of our website as well as the advertising for it

  • ensure the permanent functionality of our information technology systems and the technology of our website

  • provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack

This anonymously collected data and information is therefore evaluated by Sprachbrücke- Übersetzungsbüro statistically on the one hand and also with the aim of increasing data protection and data security in our company, in order ultimately to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files is stored separately from all personal data provided by a data subject.

Routine Deletion and Blocking of Personal Data

The controller responsible for processing processes (in this sense also: stores) personal data of the data subject only for the period necessary to achieve the purpose of storage or insofar as this is provided for by the European legislator for directives and regulations or another legislator in laws or regulations to which the controller responsible for processing is subject.

If the purpose of storage no longer applies or if a storage period prescribed by the European legislator for directives and regulations or another competent legislator expires, the personal data is routinely blocked or deleted in accordance with the statutory provisions.

  • the categories of personal data processed

  • the recipients or categories of recipients to whom the personal data has been disclosed or will be disclosed, in particular recipients in third countries or international organizations

  • if possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining that duration

  • the existence of a right to rectification or deletion of the personal data concerning them or to restriction of processing by the controller or a right to object to such processing

  • the existence of a right to lodge a complaint with a supervisory authority

  • if the personal data is not collected from the data subject: all available information about the origin of the data

  • the existence of automated decision-making including profiling pursuant to Article 22 paragraphs 1 and 4 EU-DSGVO and, at least in these cases, meaningful information about the logic involved as well as the scope and intended effects of such processing for the data subject

Furthermore, the data subject has a right to information as to whether personal data has been transferred to a third country or an international organization. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards relating to the transfer.

If a data subject wishes to exercise this right of access, they may contact the controller responsible for processing at any time.

Right to Rectification

Every data subject affected by the processing of personal data has the right to request the immediate rectification of inaccurate personal data concerning them. If a data subject wishes to exercise this right of rectification, they may contact the controller responsible for processing at any time.

Right to Erasure (Right to be Forgotten)

Every data subject affected by the processing of personal data has the right to request from the controller that the personal data concerning them be deleted immediately if one of the following reasons applies and insofar as the processing is not necessary:

  • The personal data was collected or otherwise processed for purposes for which it is no longer necessary.

  • The data subject withdraws their consent on which the processing was based pursuant to Art. 6 para. 1 letter a EU-DSGVO or Art. 9 para. 2 letter a EU-DSGVO, and there is no other legal basis for the processing.

  • The data subject objects pursuant to Art. 21 para. 1 EU-DSGVO to the processing and there are no overriding legitimate grounds for the processing, or the data subject objects pursuant to Art. 21 para. 2 EU-DSGVO to the processing.

  • The personal data has been processed unlawfully.

  • The deletion of the personal data is necessary to fulfill a legal obligation under Union law or the law of the Member States to which the controller is subject.

  • The personal data was collected in relation to information society services offered pursuant to Art. 8 para. 1 EU-DSGVO.

If one of the above-mentioned reasons applies and a data subject wishes to arrange for the deletion of personal data stored by Sprachbrücke- Übersetzungsbüro, they may contact the controller responsible for processing at any time. The data subject’s request for deletion will then be complied with immediately.

If the personal data has been made public by Sprachbrücke- Übersetzungsbüro and our company, as controller pursuant to Art. 17 para. 1 EU-DSGVO, is obliged to delete the personal data, Sprachbrücke- Übersetzungsbüro shall take appropriate measures, including technical measures, taking into account the available technology and implementation costs, to inform other data controllers who process the published personal data that the data subject has requested these other controllers to delete all links to this personal data or copies or replications of this personal data, insofar as processing is not required. The controller responsible for processing will take the necessary action in each individual case.

Right to Restriction of Processing

Every data subject affected by the processing of personal data has the right to request from the controller the restriction of processing if one of the following conditions is met:

  • The accuracy of the personal data is disputed by the data subject, for a period enabling the controller to verify the accuracy of the personal data.

  • The processing is unlawful, the data subject rejects the deletion of the personal data and instead requests the restriction of the use of the personal data.

  • The controller no longer needs the personal data for the purposes of processing, but the data subject needs it for the assertion, exercise or defense of legal claims.

  • The data subject has objected to processing pursuant to Art. 21 para. 1 EU-DSGVO and it has not yet been established whether the legitimate grounds of the controller override those of the data subject.

If one of the above conditions applies and a data subject wishes to request the restriction of personal data stored by Sprachbrücke- Übersetzungsbüro, they may contact the controller responsible for processing at any time. The restriction of processing will then be arranged immediately.

Right to Data Portability

Every data subject affected by the processing of personal data has the right to receive the personal data concerning them, which was provided by the data subject to a controller, in a structured, commonly used and machine-readable format. They also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that the processing is based on consent pursuant to Art. 6 para. 1 lit. a EU-DSGVO or Art. 9 para. 2 lit. a EU-DSGVO or on a contract pursuant to Art. 6 para. 1 lit. b EU-DSGVO and the processing is carried out using automated procedures, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Furthermore, when exercising the right to data portability pursuant to Art. 20 para. 1 EU-DSGVO, the data subject has the right to obtain that the personal data is transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of other persons.

To exercise the right to data portability, the data subject may contact the controller responsible for processing at any time.

Right to Object

Every data subject affected by the processing of personal data has the right, on grounds relating to their particular situation, to object at any time to the processing of personal data concerning them which is based on Art. 6 para. 1 letters e or f EU-DSGVO. This also applies to profiling based on these provisions.

In the event of an objection, Sprachbrücke- Übersetzungsbüro will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defense of legal claims.

If Sprachbrücke- Übersetzungsbüro processes personal data for direct advertising purposes, the data subject has the right to object at any time to the processing of personal data for such advertising. This also applies to profiling insofar as it is connected with such direct advertising. If the data subject objects to Sprachbrücke- Übersetzungsbüro processing their personal data for direct advertising purposes, Sprachbrücke- Übersetzungsbüro will no longer process the personal data for these purposes.

Furthermore, the data subject has the right, on grounds relating to their particular situation, to object to the processing of personal data concerning them which is carried out by Sprachbrücke- Übersetzungsbüro for scientific or historical research purposes or statistical purposes pursuant to Art. 89 para. 1 EU-DSGVO, unless such processing is necessary for the performance of a task carried out in the public interest.

To exercise the right to object, the data subject may contact the controller responsible for processing directly. The data subject is also free, in connection with the use of information society services, notwithstanding Directive 2002/58/EC, to exercise their right to object by means of automated procedures using technical specifications.

Automated Decisions in Individual Cases Including Profiling

Every data subject affected by the processing of personal data has the right not to be subject to a decision based solely on automated processing — including profiling — which produces legal effects concerning them or similarly significantly affects them, provided that the decision:

  • is not necessary for entering into or performing a contract between the data subject and the controller, or

  • is authorized by Union or Member State law to which the controller is subject and such law contains appropriate measures to safeguard the rights and freedoms and the legitimate interests of the data subject, or

  • is made with the explicit consent of the data subject.

If the decision is necessary for entering into or performing a contract between the data subject and the controller or is made with the explicit consent of the data subject, Sprachbrücke- Übersetzungsbüro shall take appropriate measures to safeguard the rights and freedoms and legitimate interests of the data subject, including at least the right to obtain human intervention on the part of the controller, to express their own point of view and to challenge the decision.

If the data subject wishes to exercise rights relating to automated decisions, they may contact the controller responsible for processing at any time.

Right to Withdraw Consent under Data Protection Law

Every data subject affected by the processing of personal data has the right to withdraw consent to the processing of personal data at any time.

If the data subject wishes to exercise their right to withdraw consent, they may contact the controller responsible for processing at any time.

Data Protection for Applications and in the Application Procedure

The controller responsible for processing collects and processes the personal data of applicants for the purpose of handling the application procedure. Processing may also be carried out electronically. This is particularly the case when an applicant sends the relevant application documents electronically, for example by e-mail, to the controller responsible for processing. If the controller responsible for processing concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of handling the employment relationship in compliance with the statutory provisions. If no employment contract is concluded with an applicant by the controller responsible for processing, the application documents will be automatically deleted six months after notification of the rejection decision, unless other legitimate interests of the controller responsible for processing oppose deletion. Another legitimate interest in this sense is, for example, an obligation to provide evidence in proceedings under the General Equal Treatment Act (AGG).
